In brief: Mexico faces more US labour dispute settlement panels

*The Office of the US Trade Representative (USTR) has requested the establishment of three dispute settlement panels under the US-Mexico-Canada agreement (USMCA) after failing to reach agreements with Mexico on alleged labour rights violations. The panels relate to labour disputes at a facility owned by tyre manufacturer Pirelli Neumáticos in Silao de la Victoria municipality, Guanajuato state; a facility run by auto parts supplier Bader de Mexico in León, also in Guanajuato; and a facility operated by small arms manufacturer Industrias Tecnos in Cuernavaca, Morelos state. In all cases the US had asked Mexico to review whether workers were being denied the right to freedom of association and collective bargaining, with a resolution failing to be reached. These mark the fourth, fifth, and sixth times that the US has requested a dispute settlement panel under the USMCA’s rapid response labour mechanism (RRM). The USTR notes that the US and Mexico have been able to cooperate successfully to address labour rights violations in at least 22 other cases.
