CHILE: 'Due obedience' revived in case against general

A high-profile case has again brought to the fore a highly controversial juridical problem: how far down the chain of command should military officers be held criminally liable for the crimes committed by the Pinochet régime. Lying dormant is a proposal floated by former president Ricardo Lagos to limit responsibility along lines similar to those used in the Nurenberg trials. A rival proposal is in the pipeline, however: a bill barring any recourse to 'due obedience' as an exculpatory argument. The case of General Gonzalo Santelices could tilt the balance in either direction.
