ARGENTINA: Supreme Court avoids the tough question

The war began in 2008; the de-investment legal battle in relation to Article 161 of the 2009 media law was fought in the courts all the way to the supreme court of justice, which this week gave the government hope that it may come out the victor. However, the ruling criticises both the government of President Cristina Fernández and the country’s largest media group, Grupo Clarín, indicating that each side may use the ruling to prepare new ammunition and continue the confrontation until there are no more legal recourses left. Nonetheless, it is clear from the document that the media group’s chances of winning the war have been highly reduced by the court’s resolution; its last hope lies in winning small battles to buy time.
