GUATEMALA: Top court faces fresh attacks

At the end of last week Alianza por las Reformas, a local platform comprising various civil-society groups, was compelled to release a statement urging Guatemala’s executive and legislature to respect and heed constitutional court (CC) resolutions. This is in response to renewed attacks on the court from President Jimmy Morales as well as the 158-member unicameral congress over various recent rulings – including that suspending the election of 13 new supreme court (CSJ) magistrates. Morales’ response is nothing new: he has previously criticised the court (and at times failed to heed rulings) relating to issues such as the continuance of the International Commission against Impunity in Guatemala (Cicig) and the recent migration deal with the US [WR-19-30]. However, in one worrying sign, President-elect Alejandro Giammattei has also challenged the CC, suggesting that the tensions between different branches of government could continue under his mandate which begins in January.
