In brief: Peruvian court rejects appeal to write off tax debt

* Peru’s constitutional court (TC) has rejected an appeal to write off PEN9.25bn (US$2.6bn) worth of debt owed by 158 companies to the country’s tax agency (Sunat). Companies including Chile-based Latam Airlines, Brazilian construction firm Odebrecht, Spanish telecommunications company Telefónica, and Peruvian mining company Buenaventura, had called for this debt to be prescribed on the basis that it had been generated before 2012. The appeal was rejected by four votes to two, on the basis that Sunat is currently in the process of negotiating the repayment of these debts with the companies in question. TC president, Marianella Ledesma, insisted that “these large companies must pay their taxes just as all taxpayers do in this country, without any distinction”. This ruling does not guarantee the full repayment of this debt, but ensures that negotiations will be able to continue.
