Argentina: On 3 June, Argentina’s state-owned oil firm, YPF, filed a supplemental brief with the US Supreme Court in relation ot the YPF v Petersen Energia Inversora SAU case that the Supreme Court is expected to rule on later this month. The case relates to an appeal against an intermediate court decision to accept jurisdiction over the government of Argentina and YPF which was re-nationalised in 2012. The case is being brought in the US, as the US Court of Appeals held that the US jurisdiction over the case was not defeated by Argentina’s sovereign immunity, as Argentina’s actions were commercial in nature. The plaintiff has petitioned the US Supreme Court in a writ of certiorari to seek the Court’s review of the judgement by the lower court. The case will be heard this month.
