BRAZIL: Release of drug trafficker sparks judicial debate

André ‘André do Rap’ de Oliveira Macedo, a presumed leader of Brazil’s Primeiro Comando da Capital (PCC) drug trafficking organisation (DTO), was released from preventative detention after supreme court (STF) Justice Marco Aurélio Mello granted him habeas corpus on 9 October. Macedo, whose release was swiftly reversed by order of the STF president Luiz Fux, then disappeared, presumably fleeing to Paraguay or Bolivia. The police are now on the hunt for Macedo, whose escape represents a victory for the PCC, Brazil’s largest DTO. The incident is an embarrassment for the STF and, not for the first time, has sparked a discussion around the laws on imprisonment while appealing.
