In brief: Colombian court suspends Petro’s control over utilities regulators

* Colombia’s supreme administrative court, the Consejo de Estado, has provisionally suspended a government decree issued on 16 February which gave President Gustavo Petro direct control of the country’s utilities regulators. In response to a complaint against the decree, the Consejo de Estado announced “the urgent precautionary measure of provisionally suspending the legal effects of Decree 227”. Petro had justified his attempt to take on the responsibilities of Colombia’s utilities regulators by alleging that these are prioritising the interests of shareholders over the general public at a time of rising household bills. Petro had been accused of overreach by the Comisión de Regulación de Energía y Gas (CREG) and the Comisión de Regulación de Agua Potable y Saneamiento Básico (CRA), the energy and gas regulator and the water regulator, respectively, and by the association of public service companies (Andesco), which argued that his actions would threaten investment and lead to possible supply failures.
