President Lula da Silva has chosen the
attorney general, José Antonio Toffoli, to take over the supreme court seat of
recently deceased judge Carlos Alberto Menezes Direito. This is Lula's eighth
nomination for the supreme court, which is made up of 11 judges. Unlike other
instances, however, Toffoli's selection has stirred up controversy, not least
because he was a lawyer for the ruling Partido dos Trabalhadores (PT) and
represented Lula during the past three presidential campaigns. This could lead
to the unprecedented rejection by congress of a presidential nomination to a
