In brief: Companies sentenced in Chile’s ‘toilet paper cartel’ case

* Chile’s supreme court has sentenced companies CMPC Tissue and SCA Chile for collusion in the country’s tissue paper market by fixing product prices and allocating market quotas to each other between the years 2000 and 2011. The judgement on the case, which is known as the ‘toilet paper cartel’ case and is considered one of the largest collusion cases uncovered in the country, began in October 2015 after the Fiscalía Nacional Económica (FNE), the national authority responsible for safeguarding competition, brought charges against the two companies. In its ruling, the supreme court has maintained a US$15m fine for SCA and slapped a US$15m fine on CMPC also. This overturns a plea bargain deal reached by CMPC with the FNE, upheld by the anti-trust court (TDLC), according to which it was exempted from a fine after confessing to its participation in the cartel and collaborating with the investigation.
