Paramilitaries who demobilised under the justice and peace process in
2006 could face prosecution, after a seminal ruling by Colombia's constitutional
court last week. The court's decision means that 17,000 paramilitaries from the
Autodefensas Unidas de Colombia (AUC), who laid down their arms on the proviso
that they would be spared prosecution, could now face trials in civil courts.
Fearful that the ruling might encourage demobilised paramilitaries to re-enlist
in criminal groups, Santos promised that he would ensure that those who signed
up to the justice and peace law in good faith would not be deserted by the
government. He will need to proceed with real caution to avoid a rift with the
